Buyer / Customer – any natural person who has reached the legal drinking and purchasing age in their country or jurisdiction of residence (including at least 18 years of age, or 21 years of age where required by applicable law), possesses full legal capacity, or any legal entity that places an Order through the Website.
Contract – the distance sales contract concluded between the Holder and the Customer following the Customer's acceptance of these Terms and Conditions and the Seller's confirmation of the Order.
Order – a request submitted through the Website by which the Customer expresses the intention to purchase one or more Products and/or Services offered by the Seller.
Product – any wine, merchandise, experience, event ticket, gift card, or other good or service offered for sale through the Website.

4. Intellectual Property
4.1. 4.2. This protection includes, without limitation, the STOKER WINES name, logos, visual identity, product names, label artwork, historical storytelling content, photography, marketing materials, and any other proprietary brand assets appearing on the Website.
4.3. No content from this Website may be copied, reproduced, modified, republished, translated, distributed, transmitted, displayed, sold, licensed, or otherwise exploited for commercial purposes without the prior written consent of the Holder or the applicable rights holder.
4.4. Users may access and print portions of the Website solely for their own personal, non-commercial use, provided that all copyright, trademark, and proprietary notices remain intact.
4.5. Any unauthorized use of the Website's content or intellectual property may result in civil, administrative, or criminal liability, as permitted under applicable law.
5. Online Sales Policy
5.1. All prices displayed on the Website are expressed in the currency applicable to the selected market, which may include Romanian Lei (RON), Euro (EUR), or U.S. Dollars (USD). Prices include VAT or other applicable taxes where required by law unless otherwise stated.
The Holder reserves the right to modify prices at any time due to changes in taxes, exchange rates, supplier costs, production costs, or other commercial factors. Price changes will not affect Orders that have already been confirmed.
5.2. Product descriptions, photographs, illustrations, tasting notes, historical references, pairing suggestions, and other information published on the Website are provided for informational purposes only. While every effort is made to ensure accuracy, such information does not constitute a contractual guarantee.
5.3. Wine is an agricultural product, and variations between vintages, bottle appearance, packaging, labels, and availability may occur. Product images displayed on the Website are illustrative only and may differ slightly from the products ultimately delivered.
5.4. Certain wines and limited-edition releases are produced in small quantities. All Orders are subject to product availability. If an ordered Product becomes unavailable after an Order has been placed, the Customer will be notified as soon as reasonably possible and offered an alternative solution, replacement (where appropriate), or refund.
5.5. The Contract between the Seller and the Customer is concluded only after the Seller has accepted the Order and issued an Order Confirmation by email or another durable electronic medium.
5.6. The Holder reserves the right to refuse or cancel any Order where required by law or where there is reason to believe the Order is fraudulent, inaccurate, cannot be fulfilled, or otherwise violates these Terms and Conditions.
6. Ordering and Payment
6.1. Orders may be placed through the Website by adding Products to the shopping cart, completing the required checkout information, and successfully completing the payment process using one of the available payment methods.
6.2. Payments may be made using the payment methods displayed during checkout, including secure online payment by credit or debit card through Stripe, Shopify Payments, or another authorized third-party payment processor.
6.3. Where payment by credit or debit card is selected, Customers will be redirected to a secure payment environment operated by the applicable payment processor. Payment information is processed directly by the payment processor and is not stored by the Holder.
6.4. Payments are processed using industry-standard encryption and security protocols designed to protect Customer payment information throughout the transaction.
6.5. The Holder does not charge additional processing fees for payments made by bank card unless expressly indicated during checkout.
6.6. The Customer is solely responsible for any currency conversion fees, foreign transaction fees, or other charges imposed by their bank or payment provider.
6.7. Adding Products to the shopping cart does not reserve inventory or constitute an Order. An Order is considered received only after the checkout process has been completed and payment has been successfully authorized.
6.8. Customers are responsible for ensuring that all billing, shipping, and contact information provided during checkout is accurate and complete. The Holder shall not be responsible for delays or failed deliveries resulting from inaccurate or incomplete information supplied by the Customer.
6.9. Order confirmations, invoices, receipts, and other transaction documents will be delivered electronically to the email address provided by the Customer during checkout.
6.10. The Holder reserves the right to request additional information or age verification before accepting or fulfilling an Order where required by law or where fraud prevention measures deem it necessary.
6.11. Alcoholic beverages are sold only to persons who have reached the legal drinking and purchasing age in the applicable jurisdiction.
By placing an Order through this Website, the Customer confirms that they satisfy all legal age requirements applicable in both the jurisdiction of purchase and the delivery destination.
The Seller reserves the right to verify the Customer's age before shipment or at the time of delivery. Orders may be refused, cancelled, or returned where age verification cannot be completed or where delivery would violate applicable laws.
6.12 The Holder reserves the right to refuse, delay, or cancel Orders destined for jurisdictions where the shipment, importation, or sale of alcoholic beverages is prohibited or restricted by applicable law.
Customers are responsible for ensuring that the purchase, importation, and receipt of alcoholic beverages complies with the laws applicable in the delivery destination.
7. Returns and Refunds
7.1. Consumers who purchase Products through the Website may have a legal right to withdraw from the Contract within the period provided by applicable consumer protection legislation.
Where Romanian consumer protection laws apply, the Buyer may withdraw from the Contract within fourteen (14) calendar days of receiving the Products without providing a reason, subject to the exceptions provided by law.
7.2. To exercise the right of withdrawal, the Buyer must notify the Seller within the applicable withdrawal period by:
sending an email to returns@stokerwines.com, clearly stating the Order number and contact details; or
completing the online Return Request Form available on the Website, where applicable.
7.3. Eligible Products must be returned within the legally applicable return period in their original condition, unopened, unused, and securely packaged to prevent damage during transport.
Unless otherwise required by law, return shipping costs shall be borne by the Buyer.
7.4. Due to the nature of alcoholic beverages, certain Products may not be eligible for return once opened, consumed, or otherwise altered, except where required by applicable law or where Products arrive damaged, defective, or incorrectly fulfilled.
7.5. Once an eligible return has been received and approved, refunds will be issued using the same payment method originally used for the purchase unless otherwise agreed between the parties.
Refund processing times may vary depending on the Customer's payment provider.
7.6. The Seller may postpone the refund until the returned Products have been received or until the Buyer provides satisfactory proof that they have been shipped, whichever occurs first.
7.7. Products returned in a condition that prevents resale—including opened bottles, damaged labels, damaged packaging, or Products showing signs of use—may not qualify for a refund or may be subject to a reduction in the refunded amount where permitted by applicable law.
7.8. Returns that do not comply with these Terms and Conditions may be refused.8. Delivery and Shipping
8.1. Products are delivered using carriers selected by the Holder or its authorized logistics partners.
Estimated delivery times are provided during checkout and may vary depending on product availability, destination, customs procedures, carrier operations, weather conditions, and other circumstances beyond the Holder's reasonable control.
Delivery dates are estimates only and are not guaranteed.
8.2. The Holder reserves the right to delay shipment or delivery where necessary due to inventory availability, production schedules, customs requirements, force majeure events, transportation disruptions, or other unforeseen circumstances.
8.3. Risk of loss or damage passes to the Customer upon delivery in accordance with applicable law.
8.4. Shipping costs are calculated during checkout based on the delivery destination, selected shipping method, package size, and applicable carrier rates.
Any customs duties, import taxes, local fees, or other governmental charges applicable in the destination country are the sole responsibility of the Customer unless expressly stated otherwise.
8.5. Customers are responsible for ensuring that an adult of legal drinking age is available to accept delivery where required by applicable law.
Failure to successfully complete age verification or delivery may result in additional shipping charges, return fees, or cancellation of the Order.
9. Warranties and Limitation of Liability
9.1. The Seller is responsible for supplying Products that conform to the Contract and applicable legal requirements. Where required by law, Consumers benefit from the statutory legal guarantee applicable to the Products purchased through the Website.
9.2. If a Product is found to be defective or non-conforming upon delivery or within the applicable legal warranty period, the Customer may be entitled to one or more of the remedies provided by applicable law, including:
a) repair or replacement of the Product, where appropriate;
b) a proportionate reduction in the purchase price; or
c) termination of the Contract and reimbursement of the purchase price where repair or replacement is impossible, disproportionate, or otherwise unavailable under applicable law.
9.3. The Customer must notify the Seller of any alleged defect or non-conformity within a reasonable period after discovering it and provide any information reasonably necessary for the Seller to assess the claim.
9.4. Except where liability cannot be excluded under applicable law, the Seller shall not be liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to loss of profits, loss of opportunity, business interruption, or reputational damage arising out of or relating to the use of the Website or the purchase of Products.
9.5. The Seller shall not be liable for delays or failures resulting from inaccurate information provided by the Customer, including incorrect delivery addresses, contact details, or failure to comply with applicable legal requirements for the purchase or receipt of alcoholic beverages.
9.6. Nothing contained in these Terms and Conditions excludes or limits any rights that Consumers may have under mandatory applicable consumer protection legislation.
10. Privacy and Confidentiality
10.1. The Holder respects the privacy of all Users and Customers and is committed to protecting personal information in accordance with applicable data protection legislation.

11.1. Where an Account is created, Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their Account.

11.3. The Holder reserves the right to suspend or terminate Accounts where fraudulent, unlawful, abusive, or unauthorized activity is suspected.

13.4. Consumers residing within the European Union may also have access to applicable alternative dispute resolution (ADR) procedures and online dispute resolution (ODR) platforms where available under applicable law.
14. Force Majeure
14.1. The Holder shall not be liable for any delay or failure to perform its obligations resulting from events beyond its reasonable control, including but not limited to natural disasters, fire, flood, severe weather, epidemics, pandemics, labor disputes, transportation disruptions, governmental actions, customs delays, cyber incidents, power outages, supplier failures, or other force majeure events.
14.2. Where such an event occurs, the Holder's obligations shall be suspended for the duration of the event, and performance shall resume as soon as reasonably practicable.
15. Severability
15.1. If any provision of these Terms and Conditions is determined by a competent court to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from these Terms without affecting the validity and enforceability of the remaining provisions.
16. Entire Agreement
16.1.
